I. General
Throughout these terms and conditions, the use of the word "ZebraByte" shall refer to ZEBRABYTE LIMITED, located at Unit 29 Highcroft Industrial Estate, Enterprise Road, Waterlooville, PO8 0BT, as the service provider. The Services provided by ZebraByte are intended for individuals, companies, legal entities, etc. who have the legal capacity to enter into a contractual relationship. The terms, conditions and descriptions of the operation of the services provided referred to in this document, including by way of external links, form an integral part of these Terms and Conditions. Any additional terms and conditions, even if known, do not form part of this document unless expressly and mutually acknowledged.
ZebraByte is the sole owner of all materials and information available on the Website. Clients or visitors of the Website may not copy, reproduce, distribute, publicly communicate, or retrieve any such material or parts thereof, in any form or by any means.
ZebraByte reserves the right to suspend the services provided in the event of a breach of the provisions below or in the absence of a reasonable response within a reasonable time regarding such breaches. ZebraByte also reserves the right to disclose client information through the Privacy Policy in order to comply with any legal requirements. Where such disclosure need not remain confidential, the client will be notified accordingly.
ZebraByte reserves the right to delete any account with 15 days' prior notice.
Any term not addressed in this document is open to interpretation and amendment by ZebraByte without prior notice.
II. Contracting
Prior acceptance of these Terms and Conditions is required for any request to purchase the services offered by ZebraByte. By placing an order, the client undertakes the beginning of a contractual relationship with ZebraByte. We will confirm this initiation promptly, but such confirmation does not constitute an obligation for either the client or ZebraByte to proceed with activation of the order. We reserve the right to accept or refuse a client's order within one business day, following examination of the authenticity and level of trust demonstrated by the client/order.
By placing an order, the client represents and warrants, on their own responsibility, that they have the legal capacity to purchase the services offered by ZebraByte for themselves or for the company they represent.
They undertake to complete all fields relating to their identification with accurate and valid data, as required for cooperation with ZebraByte. The client acknowledges that providing incorrect or incomplete information may affect ZebraByte's ability to provide the contracted services and, in certain situations, may result in ZebraByte refusing to activate such services. Data entered by the client is processed and managed in accordance with the Privacy Policy as well as the Data Processing Agreement.
III. Applicability
These provisions apply to all ZebraByte clients, holders of any packages or services offered on the website. The use of the services provided is subject solely to these Terms and Conditions and applies to all contractual relationships between the client and ZebraByte. The law under which these terms and conditions operate is the law in force at the time the cooperation begins. The Services provided by ZebraByte under the contract are available on the ZebraByte website.
It is virtually impossible to identify every possible interpretation of these Terms and Conditions and to cover every possible situation that may arise; therefore, any situation or term not directly or indirectly addressed or covered in this document shall be subject to ZebraByte's interpretation.
IV. Financial
General
The current prices are those displayed on the ZebraByte website.
Depending on the service chosen, the billing period may vary. All payments will be made on the basis of the pro forma invoice issued by ZebraByte. The client agrees to pay for the services in advance, before they are provided.
Regardless of the currency used to display prices, invoices and payments will be processed in pounds sterling (£), at the exchange rate in effect on the date the invoice is issued, in accordance with United Kingdom legislation.
Delivery
Invoices are sent electronically by email as attachments and can be downloaded at any time from the client's account. Upon request, they can also be sent with the signature of authorised personnel. If the client requests a physical copy of the invoice, the cost of delivery shall be borne by the client.
Postponement / Suspension / Reactivation
The hosting services provided by ZebraByte remain active by default for 7 days after the due date stated on the pro forma invoice.
Services that ZebraByte purchases from other providers (for example, domains, licences, SSL certificates) can only be renewed when paid for, within a period of validity equal to the due date stated on the pro forma invoice.
Clients may, at any time, request a postponement of payment in connection with services hosted by ZebraByte.
Client accounts that have not paid the service fees within 7 days of the due date stated on the pro forma invoice will be automatically suspended in the absence of proof of payment or a request for postponement.
Proof of payment will only result in the activation/reactivation of the ordered/withheld services, but the tax invoice will only be issued once the amount paid is visible in one of ZebraByte's bank accounts.
ZebraByte reserves the right to reopen/reactivate accounts only after full payment of all amounts owed by the client.
Non-payment
ZebraByte reserves the right to reduce the validity period of prepaid services in order to offset amounts owed by the client for services rendered but not paid for.
Offsetting by this method will be based on the pro forma invoices issued.
ZebraByte reserves the right to suspend the client's account if the invoice is not paid by the due date indicated on the issued invoice.
If non-payment exceeds 30 days, the account, together with all data existing on it, will be automatically deleted from the server.
Any subsequent request for the recovery or restoration of data from the account at the time of deletion, where a backup copy is still available, shall be subject to a storage and restoration fee of €25.00.
For Reseller and VPS hosting packages, in addition to the restoration fee, it will be necessary to purchase support hours for the reactivation of all services associated with these accounts.
The number of support hours required for restoration will be determined and communicated to the client following an assessment carried out by ZebraByte's technical operators.
Upgrade / Downgrade
The client may at any time upgrade or downgrade the purchased services. For an upgrade, payment is due only for the difference between the current package and the package being upgraded to, for the remaining period already prepaid for the current package. For a downgrade, the remaining credit may be used to extend the service, but we recommend consulting the ZebraByte team before carrying out these operations in relation to your needs.
The downgrade credit is calculated only for full months prepaid, in relation to the date of the request for such operations and the next due date.
Upgrade/downgrade operations or switching to a new offer are carried out free of charge once every 30 days.
If a further request of this type is made within that period, ZebraByte reserves the right to charge for the procedure within the purchased support hours.
Upgrade/downgrade operations involving account mergers, regardless of when they are carried out, will be charged against the purchased support hours.
Upgrade/downgrade operations involving the modification of the control panel, carried out at the client's request, will be charged against the purchased support hours.
Services for which values are used between a minimum and a maximum ("from" - "to") are charged at the rate displayed for the minimum values. Values available up to the maximum displayed may be selected for an additional fee, both during the ordering process and afterwards.
Refund Policy
The client has the right, at any time, to request a refund for services paid to ZebraByte, but such refunds shall be subject to the following conditions:
If the request is made within 30 calendar days of the activation of the order, the entire amount will be refunded to the client, except in cases involving the migration of data from an external provider, in which case an amount equivalent to the support hours required for the transfer will be withheld.
if the request is made more than 30 calendar days after activation of the client's order, only the amount for the remaining paid months will be refunded (in relation to the date of the request and the next due date).
if a request has already been made for the domain in question, the client will only be refunded the amount for the remaining paid months (in relation to the date of the request and the next due date).
if the request was made by the client in question, they will only be refunded the amount for the remaining paid months (in relation to the date of the request and the next due date).
If the client benefits from an offer that includes free services (for example, domains, licences, SSL certificates), the value of these will be deducted from the total amount to be refunded.
We will not refund services in the following cases:
services for which the purchase was brokered by ZebraByte in the case of the provision or reservation of such services by ZebraByte. Services falling within this category include, but are not limited to: domain registration or renewal, software licences, SSL certificates, etc.
recovery of backup copies for hosting accounts after they have been deleted, regardless of the reason for deletion
services suspended or terminated as a result of a breach of these terms and conditions, whether detected directly by ZebraByte team members or reported by a third party
The refund of the requested amount will be processed by ZebraByte within a maximum of 15 business days to the account from which payment was made, or to another account specified by the client.
The refund will be confirmed at the time it is made by issuing a tax invoice for the amount to be refunded.
The period between the cancellation and the actual receipt of the relevant amount in the client's account is not under ZebraByte's control, as it is determined by inter-bank transfer procedures and timeframes. Any amount owed by the client based on pro forma invoices issued for services rendered but not paid for will be deducted from the refund amount.
Rate Changes
We reserve the right to change the rates charged for the services presented on the website at any time.
If the new rates apply to your current services, you will be notified at least 30 calendar days before they take effect.
With regard to rate changes for new services, the minimum notice period is at least 7 calendar days.
Prepaid services will not be affected by rate changes until they are renewed.
Where rate changes also involve changes to the configuration of the contracted services, clients will be moved to new configurations with pricing or configurations as close as possible to the existing ones.
Payment Processing
Depending on the client, the payment method and the date of payment or receipt of payment, payment may be processed automatically or manually. By automatic and manual processing, we mean the direct involvement of a ZebraByte sales operator in the processing procedure.
Tax invoices for card payments will only be issued up to the second-to-last business day of the month. Payments made on subsequent days within the same month will be converted into tax invoices issued in the following calendar month, as they appear on the bank statement.
Regardless of the payment processing method or the date the tax invoice is issued, paid services will be activated by ZebraByte as soon as possible after payment is confirmed by the payment processor.
ZebraByte offers the possibility of saving card details on the platforms of partner payment processors.
In this way, the client can add one or more cards to their account at any time and use them to pay their invoices without having to go through the entire payment process by entering card details and confirming payment each time.
In addition, alongside manual use of the saved card for invoices for purchased services, it can be set up for recurring payment of one or more services, so that as soon as an invoice is issued for that service, the amount required to extend it will be automatically debited from the card.
By activating recurring payment, the client grants ZebraByte the right to collect or withdraw the amount required, equivalent to the value of extending the validity period of the service for which recurring payment has been activated.
Once received and processed, recurring payments are subject to the General Refund Policy.
Credit / Deposit
The client has the opportunity to deposit money into their account in the form of credit or funds, which will be used by the client to pay future invoices.
The invoice generated for adding credit will be subject to the tax legislation applicable to the client, which determines the applicability and rate of VAT.
The credit added to the client's account will not include the VAT paid on it, but when the credit is used or applied to pay an invoice, the VAT on that invoice will not need to be paid separately.
The use or application of these amounts shall be decided by the client and carried out manually; they will not be used or applied automatically.
Credit can only be applied to invoices if its value is equal to or greater than the invoice value, before the addition of VAT. Partial payments, i.e. using credit to pay an invoice with a value greater than the available credit, are not possible.
If one or more client services have been renewed in advance or have consumed more resources than allocated, ZebraByte reserves the right to use these amounts for the corresponding invoices generated.
The financial statement of credit/funds is permanently available in the client's account.
When credit is used to pay for certain services, in accordance with applicable legislation, the related pro forma invoices will become Service Provision invoices.
The only time a tax invoice is issued for credit is when an invoice is generated to add it.
The minimum amount that can be deposited is €10.00, and the maximum amount is €10.00. Furthermore, the total deposit amount available at any time may not exceed €10.00.
Promotions
In the case of offers with free products/services, these will only be available on ZebraByte's equipment and network. In the event of transferring services to other providers/registries, the amounts equivalent to the activation of these services will be withheld from the client. ZebraByte reserves the right to end the validity of a promotional offer at any time.
With regard to services offered free of charge, this is usually only applicable for the first year of use; in the second year, the full price must be paid if the client wishes to renew the service. ZebraByte may exempt any services it deems appropriate from this rule for an indefinite period.
The issuance of tax invoices, as well as the activation or renewal of the related services, will take place during the working hours of the sales department, excluding public holidays and non-working days.
In the event of a breach of the terms and conditions set out herein, ZebraByte reserves the right to block the refund of clients' purchases from other providers, including domain registration, renewal, software licences, SSL certificates, etc.
Promotional Coupons
Promotional coupons are organised into several categories depending on their validity, the possible number of uses, and the launch date. On this page, the promotional coupons available with hosting packages/services and the periods to which they apply will be displayed at regular intervals.
Weekly Coupons
Each week, from Monday to Sunday, a hosting package will be randomly selected to benefit from a promotional coupon. The discount amount and minimum purchase period will vary weekly, giving you the opportunity to choose the right package at a reduced price.
Flash Coupons
These coupons will only be valid for 24 hours, but the short validity period will be offset by a higher discount percentage compared to other coupons.
Monthly Coupons
Given that not everyone has the time needed to find discount coupons, we have decided that each month we will offer our clients deals on all hosting packages. The main factor for this discount will be the billing period rather than the package chosen.
Holiday Coupons
Some holidays are worth celebrating! On these occasions, ZebraByte will offer discount coupons for the entire range of hosting/web services.
Limited Coupons
Unlike the other coupons described above, these are not limited by time but rather by the number of uses. Each coupon in this category, once exhausted, will no longer be reused and will most likely never be part of ZebraByte's offer again.

V. Domains
With regard to the relationship concerning the registration/renewal of a domain name, our responsibility is limited to providing the domain name acquisition/renewal service.
ZebraByte cannot and will not verify the legal aspects of a domain name registration; the only check carried out by ZebraByte is the availability of the domain for registration. Verifying that the domain name chosen for registration does not infringe certain laws, as well as the intellectual property rights of third parties, is the client's responsibility.
In the absence of specifications to the contrary, provided via separate data through the order form or written communication to ZebraByte, domain registration will be carried out using the identification details existing in the client's account. The client thereby becomes both the lawful owner of the registered domains and legally responsible for them.
The effective allocation of the domain is not under our influence or control, and the client may be assured that registration/renewal has taken place only after we confirm the operation.
ZebraByte assumes no responsibility and provides no warranty regarding the registration/renewal of the domains in question.
Domain extensions are managed by a multitude of different organisations. Each of these organisations has its own registration, administration and dispute conditions. For a registration/renewal to be successfully completed, the client must provide the information and documents requested by ZebraByte team members, as well as carefully follow their instructions.
Once a domain is registered for a predefined period, it belongs to the client as the chosen string of characters. Changing the domain name after confirmation of registration or transfer is not possible.
The detailed requirements for each extension offered by ZebraByte can be viewed by accessing the Domain Terms.
We recommend that domain renewals be paid before the due date shown on the invoice, i.e. the expiry date, in order to avoid situations where the domain cannot be renewed.
If the domain is paid for after the due date/expiry date, ZebraByte will not be responsible for any additional fees charged by the Registrar for reactivating/renewing the domain.
ZebraByte assumes no responsibility for the availability of the domain name during the period of time that elapses between placing the order and making payment for domain registration. The domain registration service operates globally on a "first come, first served" basis.
If the contracted domain is not renewed properly and, as a result, becomes available on the market and is registered by other persons due to actions or omissions by ZebraByte or any technical malfunction that may occur, ZebraByte cannot be held liable for losses suffered by the user.
If the user suffers losses as a result of the domain being inaccessible for a period of time or being registered by other persons, the compensation granted by ZebraByte may not exceed the amount originally paid for the domain, as stated on the tax invoice. Notice must be brought to ZebraByte's attention in writing within 30 days of the date on which the situation was observed.
Registration of a domain name does not confer immunity against objections regarding the registration, reservation or use of that domain name. In the event of a dispute relating to a .ro domain name, ZebraByte will put the parties in direct contact to resolve the matter amicably.
If the two parties do not reach a consensus, the dispute may be resolved by recourse to a court.
During the amicable settlement process, the client shall support ZebraByte's innocence and shall accept that ZebraByte will take any measures it deems necessary to protect its interests, including, but not limited to, blocking, deleting or transferring the domain.
Due to the way ZebraByte's DNS service operates for shared packages through a DNS cluster, ZebraByte's DNS servers cannot have 2 domains with the same name. This can be a problem if ZebraByte's DNS servers hold a record for an expired domain and a third party places an order to host that domain name. In such a situation, in order to fulfil the order placed, ZebraByte will contact the owner of the expired domain to request deletion of the DNS record. If the client does not respond to this request, ZebraByte reserves the right to delete the domain's DNS record on its servers. This action does not affect the stored information (website, mail, databases) in any way.
VI. Liability
ZebraByte cannot be held liable for damages caused by the temporary unavailability of equipment or network, regardless of the reason for such an interruption.
This provision also includes damages resulting from data corruption or loss.
The client agrees to indemnify us and hold us harmless in connection with any claims, damages, including, without limitation, damages caused to third parties as a result of the use of services that are harmful to our client.
ZebraByte reserves the right to carry out short maintenance operations (5-10 minutes) at any time of day, in order to implement measures intended to improve the features (performance, security, reliability, etc.) of the services provided. These operations may be carried out without prior notice to affected clients.
ZebraByte assumes responsibility if the interruption of service provision was caused intentionally or is the result of negligence on the part of the ZebraByte team. The client declares that they understand and accept that the total amount of damages claimed by them for any reason from ZebraByte, and which could be paid by ZebraByte, shall not in any way or in any case exceed the total amount of the fees paid by the client to the provider on the last invoice relating to the provision of the services for which damages are claimed.
The client assumes liability for any damages caused directly or indirectly to ZebraByte through improper use of the services provided or breach of these terms and conditions. This includes, but is not limited to, legal fees, attorneys' fees, notary fees and any other expenses.
ZebraByte provides tutorials, configuration examples and answers on various aspects of the operation of services, applications, operating systems, control panels, and so on, through the website. All information in these articles has been tested and proven to be valid at the time of publication, based on current operating methods, the versions of applications available at that time, and existing documentation. ZebraByte cannot guarantee the desired functionality of the steps presented in the articles at a later date, with other configurations and other versions of the applications, and therefore ZebraByte is not responsible for any damages that may arise from applying the information provided in any articles, regardless of their type.
The application for managing the client's account and services provides the functionality and ability to move services held in the account of another ZebraByte client. Carrying out this move requires access to the holder's account, as this is the only place from which the transfer can be initiated, as well as access to the mailbox associated with the client's account in order to confirm the transfer. Due to the security measures imposed, ZebraByte assumes no responsibility for transfers carried out. The owner of the service is the client who holds the service in their account at the time any information or actions related to that service are requested.
ZebraByte cannot and will not be held responsible for resolving errors or incidents during interventions on the applications used, in cases where the respective application developers do not have a solution available to remedy such errors or cease to provide technical support.
VII. Data Integrity
For shared hosting accounts and servers managed by us, we are responsible for server security, but not for applications installed by clients.
ZebraByte assumes no responsibility for security breaches existing in clients' applications and for any damages caused by the exploitation thereof.
Liability in this respect rests with the administrator or developer of the application, as applicable.
ZebraByte assumes no responsibility for the protection of personal electronic devices used to access the contracted services. It is the user's responsibility to ensure that both the applications installed/used on their hosting accounts and their personal devices are up to date and secure.
The client will have access to accounts via a combination of username and password. The client is responsible for keeping this data, as well as any other sensitive information, secure.
The client will be responsible for any misuse arising from the authorised or unauthorised use of this data. If the client becomes aware that an unauthorised third party knows this data, they must reset it immediately.
A description of the conditions under which backups are made and maintained is available at ZebraByte backup.
However, it is important to note that we provide no guarantee regarding the integrity of backup copies, and the sole party responsible for the existence of backup copies is the data owner.
VIII. Support
Identification
Support for the services provided is available through the methods and within the timeframes set out on the contact page, regardless of the type of service contracted.
Depending on the information and/or operations requested, ZebraByte operators may identify the client as the holder of the services that are the subject of their request.
Identification methods vary depending on the contact method used by the client, as follows:
by phone - request for information from the client's account, as well as the support PIN
chat - logging into the client's account
mail or ticket - using the mailbox associated with the client's account to send requests
Refusal to comply with ZebraByte's requests makes it difficult to verify ownership and will result in ZebraByte operators refusing to act on the client's requests.
Response Time
ZebraByte aims to provide a response time of less than 60 minutes for requests submitted by email or ticket. However, this time may be influenced by the complexity of the actual request, as well as the number of requests pending at that time.
The exchange of information by phone or via the live chat application, although it takes place in real time, does not guarantee an immediate resolution of the situation presented.
Phone Support
Phone support cannot be used as a method for investigating or resolving situations in real time.
Any request that requires more than 5 minutes to investigate will be redirected to alternative support channels.
ZebraByte reserves the right to discontinue support in exceptional cases, such as:
abuse of support requests
indecent language and behaviour of any kind towards members of the ZebraByte team
Classification of requests as abusive in terms of language, and of behaviour as indecent or insulting, is at ZebraByte's discretion.
Any request that falls outside the scope of support for managed VPS and ZebraByte shared hosting will be handled within the managed hosting support hours, as applicable.
These requests include, but are not limited to:
device and mail client configurations
assistance with installed applications
any other request outside the scope of ZebraByte's standard support
Clients who provide ZebraByte services to third parties are responsible for managing the services provided to that third party and for providing the necessary technical support.
ZebraByte will not provide technical support to such third parties in these situations, unless the nature of the relationship between the ZebraByte client and the third party can be identified and determined.
VPS Hosting
ZebraByte's responsibility for VPS services is limited to operating and providing internet connectivity for the VPS. Services installed on the VPS are not covered by ZebraByte, unless the managed VPS service has been purchased.
Except for offers or promotions in which support is specified as free of charge, support is not included free of charge as part of VPS services.
Clients who wish to carry out operations outside the standard support services may purchase support hours.
ZebraByte reserves the right to refuse the installation of new applications, services or libraries, even within the scope of purchased support/administration hours.
Managed VPS
The managed VPS service is only available for VPSs purchased together with a control panel available in ZebraByte's offering.
Under the managed service, the client will not have access to the login credentials with superuser-level rights at the server level.
Administration refers to and is limited to the services and applications necessary to operate a standard hosting server provided by the installed control panel.
These include: web server, mail server, database server, control panel, FTP server, programming languages required to run client applications.
Any request relating to the installation or configuration of services or applications external to these and to the control panel will be submitted and handled during support hours.
Any request relating to the installation and configuration of external services or applications, as well as the control panel, will be subject to and handled within the purchased support hours.
ZebraByte's server administration includes the following operations:
- installation and configuration of the control panel together with its associated services
- installation and configuration of the firewall
- periodic updates of installed services
- 24/7 monitoring and intervention
- service-level optimisations
- server-level automation
Unmanaged / IaaS
IaaS owners will receive free support only for operating the purchased services and interconnecting them at the infrastructure level.
VPS configurations, networks, external storage and so on are not included in this.
Switching to managed VPS is only possible by purchasing a new VPS with this option.
Owners of these services may obtain additional technical support only by purchasing support hours.
Clients with managed VPSs will be notified if their VPS is identified as infected or compromised due to network activity or other indicators monitored by ZebraByte.
Depending on the severity of the situation and the activity of the VPS, various measures will be taken after contacting the client, such as: disconnecting public network connectivity, shutting down the VPS, etc.
Clients are responsible for identifying and removing the source of the compromise, as well as the tools used by attackers on the VPS, in order to bring it back into operation, and/or may choose to purchase a new VPS to restore valid data they hold.
If the client does not take action, does not assume responsibility, and the problematic activity of the VPS does not cease, ZebraByte reserves the right to suspend its operation for an indefinite period.
Shared Hosting
Clients with shared packages benefit from 24/7 support with regard to the operation and functionality of the services installed on the server. Requests falling outside this scope may be classified and handled either under other ZebraByte services or within purchased support hours. No change will be implemented at the shared server level that would affect the operation of the server for other clients on that server.
Shared hosting owners may choose to purchase support hours for operations not included in standard support.
Managed Hosting / xCMS
Clients who wish to receive assistance in carrying out various operations within installed applications may contract the xCMS service.

Reseller Hosting
Like shared hosting holders, clients with reseller packages benefit from 24/7 support for the operation of the services provided.
Data Migration
The transfer of client data is an operation carried out by the ZebraByte team, provided that the destination server is part of the ZebraByte network and the operation does not fall under other clauses of these terms and conditions.
This operation is free of charge as part of Shared Hosting, Reseller and Managed VPS services, within the initial order for the service.
This operation involves no cost in the following cases:
based on the initial order for a hosting service or package as part of Shared Hosting, Reseller or Managed VPS services
between servers on the ZebraByte network as a result of an Upgrade/Downgrade operation, except as specified in the description of such operations
The operation will be charged within support hours in the following cases:
transfer to a client-managed VPS
data transfers requested 30 days after activation of the ZebraByte service for accounts/sites/applications other than the main one for the service being transferred
if, due to an action/omission by the client contrary to ZebraByte's instructions, the data transfer must be restarted
Any operation that cannot be carried out by automated means and requires manual or customised intervention.
Due to the multiple possible combinations of settings, both for the application and for the programming language, we cannot offer an absolute guarantee and assume no responsibility for the optimal operation of the site/application following a package change, migration or cloning of applications. Each user may have their own configurations that can affect performance and compatibility with specific devices and environments. The client must ensure that the data has been migrated as requested, and in the case of email accounts, the user is responsible for configuring/reconfiguring the email clients they use.
ZebraByte cannot be held liable for any malfunction or difficulty accessing certain features that may arise from migration between different servers, whether at the level of the site/application or for email accounts.
Support Hours
Support hours represent the time allocated to client requests over the course of a month. These are divided into 2 categories, namely:
support hours provided by default as part of the purchased services
additional support hours, purchased for performing tasks outside of standard support
The main difference between them is the validity period and the possibility of accumulation.
Support hours provided by default are valid only for monthly periods, expire at the end of each paid hosting month, and cannot be carried over to the following month.
Support hours purchased directly may be accumulated with other support hours and do not expire.
Purchasing support hours does not guarantee that requests sent to the ZebraByte team will be handled.
The counting of support hours for requests sent to the technical team will be based on the time allocated by the ZebraByte technical operator to resolve the issue.
Support hours will be counted for all technical requests made as part of Managed VPS services, regardless of the contact method, and will be counted both for direct requests made by the account holder and for any third parties authorised to make the technical request.
By operations not included in standard support, we mean any action that can be carried out directly by the client (with or without guidance from the ZebraByte support team), but which, for various reasons, must be carried out by technical operators.
IX. Rules for Resellers / VPS Owners
The client is entitled to their own contractual relationships based on the online presence provided by ZebraByte. In this case, from our point of view, the client remains our main contractual partner. The client is obliged to pass on the terms and conditions set out in this document to third parties and to ensure that they understand, accept and comply with these terms.
In the case of changes that need to be made for resellers' / VPS holders' clients, they are required to cooperate. Upon request, they must provide us with the contact details of their clients. ZebraByte reserves the right to request directly a written confirmation of any changes that need to be made for resellers' / VPS holders' clients.
The reseller / VPS holder is responsible for any breach of the terms and conditions by their clients. This also includes financial liability for any damages caused as a result of such breaches.
The reseller / VPS holder agrees to hold ZebraByte harmless from all claims that may arise from third parties and other contractual partners.
X. Content Policy
The services provided by ZebraByte give you the freedom to upload, develop and operate applications for both private and commercial use.
The use of various applications through ZebraByte services is subject to the Terms and Conditions of those applications.
It is the clients' responsibility to identify their own information and that of other persons, legal entities and any other entities on the Internet
Compliance with copyright, trademarks and other intellectual property is the client's responsibility, and the client therefore agrees not to publish content that could infringe the rights or applicable laws of third parties.
The use of ZebraByte equipment and network is permitted only for lawful purposes.
The transmission, storage or distribution of any information, data or materials that violate applicable legal provisions, or that may directly or indirectly facilitate the violation of any legal provision, is prohibited.
Under no circumstances shall the services provided by ZebraByte be used to communicate, refer to, or direct towards any of the following:
copyrighted material or content that infringes the copyright, trademark rights or any other intellectual property rights of a third party
nudity, pornography, or any image or text containing sexual or obscene content, without complying with applicable legal requirements
child pornography
threats, abuse, harassment, defamatory statements
any image or text intended to promote xenophobia
violent text or material
defamatory, insulting or libellous content
racial or discriminatory content
deceptive, false, misleading or fraudulent content
content that invades the privacy of a third party or infringes their legal rights
vulgar, obscene, indecent or illegal content
viruses, Trojan horses or similar
pirated software or content that promotes software piracy or similar activities
The client is required to respond to ZebraByte's requests regarding complaints made by third parties about site content within 5 days of email notification. ZebraByte is not obliged to verify or review content posted by clients.
ZebraByte reserves the right to remove or modify, at its discretion, any client content deemed to violate these terms and conditions, with prior notice.
ZebraByte reserves the right to suspend the account of any client who violates these provisions without prior notice
If the client collects/processes personal data, it is their responsibility to ensure that such collection/processing complies with applicable law.
XI. Usage Policy
This policy is necessary to protect the quality of the hosting service.
We want to meet the requirements of all our clients by providing quality services, an objective that can be achieved even with our clients' support.
The way in which the client uses the services provided by ZebraByte is closely linked to the proper functioning of the equipment and network, and it is necessary to ensure a suitable environment for the hosting facilities.
We do not allow the use of programs that run continuously in the background.
We do not allow scripts to be run via schedulers set at intervals of less than 5 minutes.
We do not allow the use of CGI scripts.
The following activities are prohibited:
using ZebraByte services to create or transmit viruses, worms, mail flooding, mail bombing, or to participate in denial-of-service attacks
using proxy or IRC scripts, or FormMail, PhpShell or similar scripts, including commercial scripts containing known security vulnerabilities, chat rooms, chat wap services; IRC Egg Drop bots, torrent trackers, top sites, online games (except flash games)
collecting personal information for use for unlawful purposes
unauthorised access to data, systems or networks (phishing, spoofing, proxying, hacking, sniffing, etc.), including any attempt to probe, scan or test the vulnerability of a system or network, and to create security breaches without the authorisation of the owner of the network or system
any interference with the service provided to a user, on a server or network, such as: mail bombing, flooding, deliberate overloading of the system
spoofing of TCP/IP packets
uploading viruses, corrupted files or any other software or application that could harm a third party
restricting or preventing any other user from using ZebraByte's services
collecting information from third parties or email addresses without their consent
Any attempt to damage the servers or other clients is strictly prohibited. Any activity that affects the proper functioning of the server will be considered abuse and will be regarded as an attempt to harm other co-located clients.
Any script that poses a potential security risk or that may affect server performance or network security will be shut down or removed automatically without prior notice.
ZebraByte reserves the right to act as soon as possible to remove, block or reset access to any account, application, activity or information that, by its nature, may affect the operation of the ZebraByte network or may harm the rights of a third party.
For the proper functioning of electronic message exchange, the following provisions must be taken into account by the client.
In accordance with legal provisions, it is prohibited to carry out commercial communications by electronic mail unless the recipient has expressly consented to receive such communications.
Mail lists / Newsletter
Mailing lists may only be operated provided that individuals expressly consent to this, agree to be registered by the list operator, and remain subscribed for the entire lifetime of the mailing list.
ZebraByte requires that any commercial email or part of a mailing list contain simple and visible double opt-in / double opt-out options.
Sending bulk emails consumes server resources, which has a negative impact on the quality of the services provided to the client, which is why we have a few recommendations in this regard:
Sending should take place early in the morning (before 09:00) or in the evening, after 22:00.
Sending should be limited to a few dozen emails per minute.
Failure to comply with these recommendations may have the following consequences:
congestion of the mail server due to the high number of requests, in some cases even leading to the server becoming unresponsive;
blacklisting of the IP address from which multiple messages considered spam are sent, with repercussions for all clients hosting applications on that server;
a sharp decline in reputation with email services such as Yahoo, Gmail, etc.;
significant delays in sending messages;
inability to deliver messages to other mail servers;
impact on all clients connected to the network, due to the server's improper functioning.
ZebraByte does not limit the number of emails that can be sent per hour, but monitors SMTP traffic and reserves the right to intervene, including by deleting sent messages and contacting the client, if we consider that a particular case falls outside the scope of the purchased service package or affects the operation of the server.
If a client operates a mailing list, they are advised to contact ZebraByte to establish good sending practices or to choose an optimal service package.
The limit for an attachment is 25 MB. The maximum number of recipients per message is 25.
We do not recommend / do not allow sending to a large number of subscribers in the CC/BCC fields, as if one of the addresses is incorrect or inactive, the message will remain stuck on the server.
To prevent any negative effects on the operation of the services, ZebraByte reserves the right to limit, at any time, certain parameters of the email service provided to clients.
Anti-Spam Policy
Sending unsolicited commercial messages (SPAM) to promote any site using our servers, or using third-party servers to promote any site or application hosted on the ZebraByte network, will result in the suspension or cancellation of the client's hosting account, without prior notice.
ZebraByte does not permit the use of its services, directly or indirectly, for sending, transmitting, managing or delivering email messages:
unsolicited messages (spam) in violation of any applicable law in this area;
to email addresses obtained through abusive collection methods (harvesting);
to incomplete or incorrect addresses;
that do not comply with industry best practices;
to purchased, rented or borrowed lists;
to lists that will generate a high number of SPAM complaints;
to addresses that may result in the IP being blacklisted;
that contain or use forged headers;
that contain or use non-existent domain names;
that hide or attempt to hide the origin of transmission;
that use other deceptive addressing methods;
that use the domain name of a third party without their consent;
sent through third-party servers without their consent;
that contain false or misleading information.
The client undertakes to respond to ZebraByte's requests regarding complaints made by third parties about their activity within 5 days of the notification being sent.
ZebraByte reserves the right to request, at any time, evidence of consent given by subscribers to the operator of the mailing list.
ZebraByte reserves the right to require the list operator to demonstrate the subscription/unsubscription methods made available to subscribers.
ZebraByte reserves the right to suspend the account in the event of non-compliance with these provisions.
Sending / receiving mail
ZebraByte cannot guarantee the delivery of email messages sent from devices on the ZebraByte network to recipients' inboxes.
Furthermore, ZebraByte cannot guarantee the delivery of emails regardless of the location of the sender or recipient (internal/external to the ZebraByte network).
The sending or receiving of an email may be affected by several internal or external factors, including:
mailboxes with no available space, which can no longer receive messages;
sending IP addresses included in various blacklists, whose connection to the destination server is blocked;
malfunctions of the sending/receiving mail servers;
malfunctions at the internal/external network level;
mail servers with aggressive anti-spam filters;
email content considered spam by the sender's or recipient's server;
attachments exceeding the size accepted by the sender's or recipient's mail server;
temporary rejections of email messages as a result of greylisting policies;
etc.
Dedicated IP
The status of dedicated IP addresses allocated to clients is checked in advance, prior to actual allocation.
The check includes, but is not limited to: the status of the IP address on various blacklists, its reputation, etc.
Therefore, any subsequent change of IP address will only be made for well-founded reasons. A request to change an IP address may be refused or charged for if, as a result of actions taken by the client, the reputation or status of the IP address has been affected.
Changing the dedicated IP address will involve a one-time fee of €10.00.
Services that benefit from a single dedicated IP address will have that IP address allocated to all domains, subdomains and accounts running under that service.
If you wish to separate domains, subdomains or accounts onto other dedicated IP addresses, these must be purchased separately.
IPv6 allocation (where possible) is carried out in parallel with IPv4 allocation, as the two are not mutually exclusive. The service provided will run simultaneously on IPv4 and IPv6. The IPv6 address may be removed at the client's request.
XII. Resources
Each shared hosting account has its own resources, depending on the type of package purchased. A detailed list of these resources can be viewed by accessing the Resource Usage section.
All accounts are monitored to track resource consumption.
ZebraByte reserves the right to contact the client regarding a package upgrade or to send suggestions for improving performance, in the event that one or more resources of the hosting account held are frequently used at maximum capacity.
If the client does not take steps to increase the available storage space, and it falls below 1% or 1 GB, ZebraByte reserves the right to suspend the operation of the VPS in order to protect against the corruption of information stored on it.
Files larger than 500 MB may not be stored on shared hosting accounts, except for the account backup.
ZebraByte's services may not be used for audio or video streaming, file sharing or image sharing.
It is also prohibited to use our servers as a storage medium (e.g. films, mp3s, photos, archives, software kits, etc.).
ZebraByte reserves the right to suspend, without prior notice, applications or accounts whose activity prevents or in any way affects the proper functioning of the server.
The Reseller plan allows for the creation/addition of 10 free hosting accounts, including the reseller account. Clients who wish to create/add a larger number of accounts have the option of purchasing additional limits beyond the standard ones.
In the case of VPS servers managed by ZebraByte, licences installed on the VPS may limit the number of accounts and/or domains that can be created using that licence. This limitation may be changed and/or removed at any time by downgrading/upgrading the licence associated with the control panel.
The space provided for VPS packages represents the total value allocated to the server, but not the value that the client will directly benefit from for their own data (site files, databases, emails).
Of the total space allocated, part will be occupied/used by the operating system installed on the VPS, as well as by any control panel. The space directly available for the client's data is smaller.
Part of this space must always remain available for updating the operating system and other applications installed on the server.
Clients with VPSs managed by ZebraByte will be automatically notified when the available space on the VPS begins to approach a critical level, so that they can take the necessary action.
To describe the extended capacity of the features of the services offered, terms such as "Unlimited" and/or "Unmetered" may be used in some cases.
These terms refer to the possibility of using a large amount of resources, and not to the possibility of using them without limit, i.e. without any upper threshold.
These thresholds for resources that can be created or added (mailboxes, subdomains, parked domains, additional domains, etc.) are set at 999.
With regard to the monthly traffic threshold, this is determined by the bandwidth allocated to the contracted service. At a constant speed of X Mb/s (bandwidth/second), it is not possible to exceed a monthly traffic volume greater than X * S (bandwidth/second * number of seconds in the month)
For some ZebraByte services, the terms "Unlimited" and/or "Unmetered" are used to describe certain resources included in the package (e.g. RAM, CPU, storage space, traffic).
These terms refer to the fact that the resources do not have a predetermined limit within the contracted package and may be used extensively, to the extent that such use falls within the normal and reasonable practices of the service (fair use).
Use of resources in a manner that affects the performance of the service for other clients, abuse, or improper use of resources (e.g. mining activities, unauthorised storage of large files, unauthorised streaming) may result in ZebraByte taking action, including suspension of the service or a recommendation to upgrade.
Use of resources
Shared VPS
Within VPSs with shared resources, sustained maximum-level use of resources is prohibited at all times.
ZebraByte will monitor resource consumption and notify the client in cases where consumption exceeds the following thresholds:
100% CPU for periods longer than 30 minutes
The client will have the option either to identify and resolve the situation, or to migrate to a Dedicated VPS.
ZebraByte reserves the right to suspend the operation of the VPS if its processes affect the proper functioning of other VPSs on that node, or in the event of repeated disregard of notifications sent in this regard.
Dedicated VPS
The resources allocated to this type of VPS are 100% dedicated to the client.
This means that the RAM, CPU cores and storage space included in the package are not shared with other network users and may be used exclusively for the client's applications and services.
Unlike VPSs with shared resources, where maximum-capacity use is restricted to maintain node stability, in the case of VPSs with dedicated resources, the client is free to utilise resources at maximum capacity, for extended periods, without the risk of suspension due to consumption.
This type of VPS is particularly recommended for:
complex projects requiring constant, high resources (enterprise applications, large e-commerce platforms, data processing solutions);
services that run CPU/RAM-intensive processes (e.g. large databases, application servers, gaming servers, virtualisation solutions in turn);
clients who want stability and predictable performance, without compromise.
ZebraByte guarantees that these dedicated resources are not artificially limited and may be used in full, in accordance with the package purchased.
XIII. Validity
This document is valid for an indefinite period.
ZebraByte reserves the right to make changes to this document, which is why clients are advised to review it periodically.
In the event of major changes, clients will be notified by email.
